ELS-ED: Společná pozice Evropské lidové strany a Evropských demokratům k chemické politice EU

"The EPP-ED group has agreed a common position for the first reading of the EU chemicals policy, tabled by the commission. This position is consensus in the three main committees involved: common market, industry and environment," said the European Parliament's rapporteur for the Internal Market Committee, Hartmut Nassauer, in Brussels today. The Member of European Parliament declared there was agreement that the commission's proposal for a volume-based assessment has to be supplemented by a risk-based registration.

The aim was to "find the most direct, efficient, fast, unbureaucratic and least expensive way of registration" for chemicals according to their actual risk potential, Nassauer said. The EPP-ED working group in charge of this dossier had therefore agreed on the following:

1. The application of the regulation is to be re-drafted due to the exclusion of chemicals in medical products, foodstuffs, drugs, animal feed, pesticides, waste, metals as well as alloys. Research and development are also to be excluded, as conditions in these areas are fundamentally different from industrial production and consumption.

2. In order to establish a register of chemicals without undue delay, a pre-selection of the approximately 30.000 substances to be registered should be considered. For these substances a minimum data set has to be established, the basis for a first risk-based assessment.

3. The register should form the basis for priority lists according to risk- and volume-based criteria: the more dangerous a substance is after its first assessment, the earlier it has to be assessed in the full procedure, and the bigger is the data set required. This would enable a risk-based assessment of all 30.000 substances within the 11 years foreseen.

4. The agency charged with the registration has to be significantly strengthened. The mechanisms for cooperation between the agency and the national administrations have to be clearer. The agency must have the legal responsibility for the registration, as well as the last say in the assessment.

5. WTO-compatibility of the procedure has to be assured, as well as the guarantee for data protection, including confidential business information, whilst not precluding transparency for consumers. The position of the European Parliament has to be secured by a revision clause.

In view of the further legislative process, Nassauer made it clear that votes in the committees concerned should be concluded before the summer recess, so that the first reading could take place in the plenary in autumn. The EPP-ED group was the advocate of a modified REACH registration system which would lead to a better level of protection for the environment as well as consumers whilst administrative procedures and costs are to be kept as low as possible: "This would require a complete redrafting of the clauses for registration, bearing in mind common market legislation. However, still not solved is the problem of unfair competition, if REACH is a solely European law", Nassauer concluded.
